Water pollution litigation is drawn out, and expensive, and potentially high risk for both parties especially where the science is unsettled. But, in many cases, however, it doesn’t have to be that way. Getting the parties to agree on a settlement can be difficult, but it is not impossible. While certainly some cases must be tried, the vast majority can and should be resolved without unnecessary time and unreasonable expense. Although the parties and respective experts can advocate for extremely different results, counsel working with a knowledgeable and experienced mediator can find mutually agreeable ground and settlement numbers. This webinar will discuss these topics and processes, as well as certain ethical issues which attorneys for both plaintiffs and defendants in these water pollution cases may face, and strategies for how to approach them.
