Our work with U.S. and international biotechnology companies combines regulatory compliance, transactional support, and litigation, providing a stable foundation for their business objectives.
Why B&D?
Beveridge & Diamond has been active in food and agricultural biotechnology since the earliest days of the federal regulation of biotechnology in the United States. We successfully represented the industry’s interests when the Foundation on Economic Trends challenged the Environmental Protection Agency’s (EPA) first approval of an environmental release of a genetically modified organism. We also represented the first company to apply for pre-market approvals from multiple agencies under the Coordinated Framework for the Regulation of Biotechnology.
We draw on our broad environmental knowledge-base to help companies in the biotech industry develop and implement regulatory strategies and defend against critics amidst rapid legal and technological changes.
With the tremendous growth of biotechnology, product regulation under the Environmental Protection Agency, the Food and Drug Administration, the U.S. Department of Agriculture, and various state counterparts has also expanded. As companies come up with newer, safer, and better ways of achieving plant vitality, pest control, and animal breeding, we work with them to ensure that their products come to market and remain commercially viable in the dynamic regulatory environment.
Clients
We represent both large and small companies, as well as task forces of companies, with an emphasis on companies that invest in research to develop and defend new products. Key clients of ours, such as Bayer, BASF, Dow, and DuPont, sell both pesticides and seeds. Other of our biotech clients include companies involved in animal areas, as well as row crops and citrus, retailers that sell pesticides, and large manufacturers and medical devices makers with industrial biocides.
These clients choose B&D because our breadth and depth of experience in biotechnology give them a competitive edge in a market that is expected to be worth nearly $1 trillion by 2025. With the number of companies and types of products that include biotechnology continuing to expand—and with companies and industries becoming intertwined—our deep history, knowledge, and experience will help clients achieve freedom to operate in a dynamic industry.
Focus
We work with companies throughout the distribution chain, including data generators, research and development firms, growers, breeders, importers, exporters, retailers, and distributors, in an increasingly international market where they must comply with any number of foreign requirements. We maintain a highly skilled and trusted international network of outside experts to draw upon when needed and can efficiently address the regulatory requirements in nearly all major, international jurisdictions.
Employing a nimble team that includes lawyers as well as scientists, technical experts, and data compensation experts, we continue to find creative and client-specific solutions to novel regulatory questions involving cutting edge technology. We can assist clients with compliance, transaction, and litigation issues such as:
- Getting products to market.
- Keeping products on the market.
- Using products in specific settings.
- Defending companies against claims brought under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Federal Food, Drug, and Cosmetic Act (FDCA), the Endangered Species Act, and other federal, state, and international laws.
- Meeting requirements across global jurisdictions to allow buying and selling transactions to take place.
