Principals Karen Hansen (Austin) and Parker Moore (Washington, DC) were quoted in a January 2 article in Law360 titled “Environmental Legislation and Regulation to Watch in 2015.” The article discusses the outlook for environmental legislation and regulation in 2015.

Karen noted that "there's something on the agenda that will impact every company in at least one way, and maybe multiple ways, depending on their business. Many of these regulatory proposals will spur litigation challenges too, either facial challenges or as proposals are implemented."

Commenting on pending rulemakings by the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) regarding critical habitat, Parker noted that industry groups have asked the FWS and NMFS to withdraw the proposed rules and that if they do not, there will likely be legal challenges. "There are major problems with both rules, and aspects of them plainly exceed the services’ ESA authority,” he explained.
